We use sensitive personal information only for limited purposes, such as providing the requested service, account access, security, fraud prevention, support, legal compliance, or responding to your request.

We do not use sensitive personal information to infer characteristics about you.

We do not use sensitive personal information for marketing personalisation, behavioural analytics, audience building, customer segmentation, or advertising in a way that requires a separate β€œLimit Use of Sensitive Personal Information” link under California law.

For residents of states that require consent to process sensitive personal information, including Virginia, Colorado, Connecticut, Montana, Oregon, New Jersey, New Hampshire, Delaware, Maryland, Minnesota, Texas, and similar states, we do not knowingly process sensitive personal information without consent where consent is required.

If you voluntarily provide sensitive information in a support request, review, form, email, message, or other communication, we will treat that as consent to process it for the limited purpose of responding to or handling that request.

10. Automated Processing, Profiling, and Personalisation

We and our service providers may use automated tools to help operate our store, recommend products, measure marketing, prevent fraud, analyse customer behaviour, segment audiences, and understand business performance.

  • Customer lifetime value

  • Marketing engagement

We may use service providers that incorporate artificial intelligence, machine learning, automation, or similar technologies into their products.

These tools may help with analytics, fraud prevention, customer support, marketing optimisation, product recommendations, search, attribution, personalisation, and operational efficiency.

We do not authorise vendors to use identifiable customer personal information for unrelated AI model training without appropriate disclosure, contractual protection, or consent where required.

13. Security

We use reasonable administrative, technical, and organisational safeguards designed to protect personal information.

These safeguards may include encryption in transit, access controls, account authentication, secure vendor platforms, staff access limits, logging, monitoring, and vendor diligence.

14. International Transfers

We are based in New Zealand and the United States, and our service providers may process personal information in other countries.

Your personal information may be transferred to, stored in, or processed in countries outside your country of residence, including New Zealand, the United States, Australia, Canada, the United Kingdom, the European Economic Area, Taiwan, and other countries where our service providers or their subprocessors operate.

Privacy laws in those countries may differ from the laws in your country.

We do not directly target or sell to residents of the European Economic Area unless we later change our business operations. Some providers may nevertheless process data from or in the EEA as part of their global infrastructure.

We will respond within the time required by applicable law.

16. Authorised Agents

If you believe a child has provided personal information to us, contact us at hello@sidekicksoda.com.

20. Notice of Financial Incentive

The exact offer may vary by campaign and will be shown at the time of signup or participation.

These offers may be considered a financial incentive or price or service difference under California law because they involve the collection of personal information, such as your name, email address, phone number, marketing preferences, referral activity, or purchase information.

Participation is voluntary. You may opt in by following the signup or participation instructions shown with the offer. You may withdraw by unsubscribing from marketing emails, replying STOP to SMS messages, or contacting us.

The value of the personal information related to these offers is reasonably related to the value of the benefit, discount, reward, or offer provided to you, together with our anticipated business value from being able to market to you, attribute referrals, or understand customer engagement.

Withdrawing from marketing will not affect completed purchases or discounts already validly used, but you may no longer receive future marketing offers.
